1. Introduction

This Privacy Policy explains how 미쁨유한책임회사(Mipeum LLC.) (the "Company," "we," "us," or "our"), as a software developer and publisher, collects, uses, and protects information when you use the Birdieswap website and interface ("Birdieswap").

Birdieswap is available at birdieswap.com and its official subdomains, including (without limitation) app.birdieswap.com, www.birdieswap.com, and docs.birdieswap.com, as well as any related pages, interfaces, APIs, or applications (collectively, the "Interface").

Birdieswap provides a non-custodial Interface and smart contract system intended to facilitate user interactions with decentralised finance ("DeFi") protocols via a dual-layer ERC-4626 vault architecture and related components, including integrations with third-party yield sources and decentralised exchanges (e.g., initially Uniswap v3, subject to change), and other integrated protocols.

By using Birdieswap, you acknowledge that you have read and understood this Privacy Policy and agree to its terms.

2.Information We Collect

We do not collect personal data in the traditional sense (e.g., names, physical addresses, government identifiers) when you use Birdieswap. However, the following information may be processed:

(a) Blockchain transaction data (public data)

  • Public wallet addresses, transaction hashes, smart contract interactions, and related on-chain events recorded on public blockchains.

  • Birdieswap may use an internal indexer to cache and query publicly available blockchain data (including event data) for functionality, performance, and reliability. This indexing is a convenience layer over public data and does not change the public nature of such data.

Wallet addresses and on-chain activity are generally pseudonymous and do not directly identify you by name, but may be considered personal data in some jurisdictions depending on context.

(b) Interface usage and technical data (minimal)

  • Limited, non-identifiable technical data may be processed to operate and secure the Interface (e.g., basic request/response logs, error logs, and timestamps).

  • We do not use third-party analytics tools and do not intentionally collect IP addresses for analytics or marketing purposes.

(c) Consent records (EIP-712 signatures)

  • When you first access the Interface, you may be asked to sign an EIP-712 message acknowledging or accepting the Terms of Service, Privacy Policy, and Risk Disclosures.

  • We may store the signed message and associated metadata, including the wallet address, timestamp, and document version identifiers.

  • Document versions are identified by date-based versions and verifiable document hash values. PDF archive copies and their corresponding hash values are published on the documentation site, and the EIP-712 message signed by users includes the relevant hash value for verification.

(d) Voluntary submissions (support and feedback)

  • Information you provide voluntarily through support or feedback channels, such as email (e.g., [email protected]) or community channels (e.g., Discord or Telegram). This may include message content and any information you choose to share.

3. How We Use Information

We use the information we process to:

  • Operate and maintain the Interface and related software features.

  • Provide core functionality (including presenting on-chain data, positions, and related metrics) and improve stability and user experience.

  • Diagnose and fix technical issues, prevent abuse, and maintain security.

  • Maintain verifiable consent records (including EIP-712 signatures) for compliance and auditability.

  • Comply with applicable legal obligations, if required.

We do not use your data to personally profile you, and we do not sell your information to third parties.

Fees Notice: Your use of integrated protocols may be subject to fees, including (without limitation) third-party protocol fees, DEX trading fees, performance fees, management fees, and transaction costs. Certain fees are set and collected by independent third-party protocols and are not controlled by us.

4. Cookies, Local Storage, and Similar Technologies

We use a limited number of cookies, local storage, or similar technologies strictly for essential functionality, such as:

  • remembering connection or session-related Interface state; and

  • storing whether a referral code has been applied.

We do not use cookies for advertising, cross-site tracking, or behavioral profiling. You can manage or disable cookies through your browser settings; however, some essential features may not function properly if you disable them.

5. Public Nature of Blockchain Data

Any transaction you make through Birdieswap is recorded on public blockchains and is accessible to anyone. We cannot modify, remove, or control such public blockchain data.

6. Third-Party Services and Integrations

Birdieswap connects to DeFi protocols operated by independent third parties, including third-party yield sources/vaults and decentralised exchanges. These third parties may have their own privacy practices and terms. We are not responsible for their policies or actions.

7. Data Retention

We retain minimal information for only as long as reasonably necessary to operate and secure Birdieswap and to meet legal or compliance requirements.

Our current retention practices are:

  • Consent records (EIP-712 signature acknowledgements and related metadata): retained for up to 3 years, after which they are automatically deleted.

  • Voluntary support or feedback submissions: retained for up to 3 years, after which they are automatically deleted.

  • Minimal security and availability logs: retained for up to 90 days.

Public blockchain data is permanent and cannot be deleted.

8. Security Measures and User Awareness

We implement reasonable security measures to protect information from loss, theft, misuse, and unauthorised access. However, no security measure can guarantee absolute protection, especially for public blockchain transactions.

You are solely responsible for ensuring that you are accessing the genuine Birdieswap Interface at birdieswap.com or its official subdomains. The Interface could be subject to hacking, phishing, DNS hijacking, spoofing, or other malicious interference. Interacting through a compromised or fraudulent interface may result in total and unrecoverable loss of assets or data.

9. No Guarantee of Accuracy

Any performance metrics, APRs/APYs, estimates, pool data, or other informational content shown in the Interface is for informational purposes only. It may be delayed, inaccurate, incomplete, or sourced from third-party APIs or public data. You are solely responsible for verifying any such information before acting on it.

10. International Data Transfers

Birdieswap may be accessed globally, and certain infrastructure providers or processing activities may be located outside your country of residence. By using Birdieswap, you consent to the transfer and processing of any collected or processed data outside your country of residence, subject to applicable laws.

11. Changes to This Policy

We may update this Privacy Policy at any time by posting a revised version on our website or Interface. Your continued use of Birdieswap after such updates constitutes your acceptance of the revised Privacy Policy.

12. Future Operator

If operation of Birdieswap is transferred to a future operator, your continued use after notice of such transfer constitutes your acceptance of the future operator’s privacy policy, provided it does not materially diminish your rights or increase your obligations without your affirmative consent where required by applicable law.

13. Limitation of Liability

To the fullest extent permitted by law, the Company, its affiliates, and their personnel will not be liable for any damages, losses, or claims arising from:

  • Your reliance on any data or information provided through the Interface.

  • Loss of assets, performance shortfalls, protocol failures, or third-party actions.

  • Security breaches, DNS hijacks, spoofed interfaces, or unauthorised access to your wallet or transactions.

To the fullest extent permitted by law, our total liability to you will not exceed USD $100. This limitation applies even if the remedies fail their essential purpose.
